Terms of Service

1. Acceptance of Terms

By accessing and using Majik's Online at majiks.online ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.

2. Description of Service

Majik's Online is a music streaming and distribution marketplace. Listeners can discover, stream, and purchase music. Creators can publish, price, and sell their tracks with tiered licensing options. The platform also offers radio stations, playlists, and personalized discovery.

3. User Accounts

Accounts are created through Unicorn Commander, our single sign-on (SSO) provider powered by Keycloak. You can sign up with Google, Microsoft, or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

4. Free Streaming and Play Limits

Unauthenticated visitors may stream public tracks without limits. Registered free users are limited to 5 plays per track. After reaching the play limit, users may purchase the track or subscribe to Listener Premium ($6.99/month) for unlimited plays and additional benefits including 15 monthly download credits and lossless audio.

5. Purchases and Licensing

Majik's Online is the merchant of record for all transactions on the platform. Tracks may be purchased individually, added to a cart for multi-track checkout, or purchased as part of an album (all tracks in the album in one transaction). Track prices are set by creators. Tracks can also be purchased with credits (bought in bundles of $5, $10, or $20).

Tracks may be purchased under three license types:

• Personal — for personal listening and non-commercial use.
• Commercial — for use in videos, podcasts, games, and other commercial projects.
• Exclusive — full exclusive rights. The track is delisted from the marketplace after purchase, though existing buyers retain access.

Free tracks are available for download at no cost and do not involve a Stripe transaction. All paid purchases are final unless otherwise required by applicable law, as they are digital goods delivered immediately upon purchase. Prices are set by the creator. Payment processing is handled by Stripe. We do not store your payment card information.

6. Creator Revenue

Creators keep 100% of personal license sales (0% platform fee). For commercial and exclusive license sales, the platform retains a 10% fee and the creator receives 90%.

Stripe Connect Payouts: To receive earnings, creators must connect a Stripe account via their creator profile. Creator payouts are processed as Stripe Connect transfers after purchase completion. The platform is not responsible for holding, escrow, or forwarding funds for creators who have not connected a Stripe account. Sales revenue from tracks where the creator has not connected Stripe will be retained by the platform. Creators are responsible for setting up their payout method promptly. Stripe's own fees (processing, transfer) are the responsibility of the creator's Stripe account.

7. Creator Subscriptions

To publish music, creators must subscribe to a paid tier:

• Producer ($9.99/mo) — 10 tracks/month, 1 artist profile, analytics, custom pricing.
• Label ($29.99/mo) — 30 tracks/month, up to 10 artist profiles, bulk publish, priority support.
• Founder Friend (Free, limited time) — 5 tracks/month, 1 artist profile. Available by invitation during early access period. May be discontinued or converted to a paid tier at any time.

Creator subscriptions may be cancelled at any time. Published tracks remain live after cancellation.

8. Creator Obligations

Creators must only publish content they have the right to distribute. Uploading copyrighted material without authorization is strictly prohibited. Creators are solely responsible for ensuring their content does not infringe on any third-party intellectual property rights.

9. DMCA and Copyright Claims

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the platform infringes your copyright, you may file a DMCA claim by contacting us at [email protected] with the required statutory information. Claims are reviewed by our team and may result in content removal if upheld. Counter-notifications are accepted per DMCA procedures.

10. Provenance Certificates

Tracks on the platform may have associated provenance certificates that record creation metadata and audio fingerprints. These certificates are informational and do not constitute a legal guarantee of authorship or ownership.

11. Prohibited Conduct

You may not use the Service to distribute infringing, harmful, or illegal content. Automated scraping, circumventing access controls, abuse of play-limit systems, or any activity intended to disrupt the Service is prohibited.

12. Termination

We may suspend or terminate your account at our discretion for violation of these terms. You may request account deletion by contacting us. Upon deletion, your personal data will be removed, but purchase records and licensing obligations remain in effect.

13. Content Ownership

Creators retain 100% ownership of all content uploaded to the platform. The platform does not claim any rights to your music, artwork, or metadata. We do not use uploaded content to train machine learning models or for any purpose beyond operating the Service.

By publishing content, you grant the platform a non-exclusive license to host, stream, and display your content to users of the Service. This license terminates when you remove your content.

14. Content Removal

Creators may remove their content from the platform at any time. Removed tracks will no longer be available for streaming or purchase. Existing buyers retain access to tracks they have already purchased.

The platform reserves the right to remove content that violates these terms, including but not limited to: copyrighted material uploaded without authorization, hate speech, content promoting violence, or any material that violates applicable law.

15. Credits and Purchases

Credits purchased on the platform are non-refundable. Credits do not expire. Track purchases made with credits are final — all digital purchases are delivered immediately and are non-refundable unless required by applicable law.

16. Acceptable Use

You may not upload content that contains hate speech, incites violence, or promotes illegal activity. You must not upload copyrighted material you do not own or have authorization to distribute. Automated abuse of the platform, including but not limited to scraping, botting play counts, or circumventing access controls, is prohibited.

17. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. To the maximum extent permitted by law, Majik's Online and Magic Unicorn shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of revenue, data, or business opportunity.

18. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email or a notice on the platform.
